General Terms and Conditions of Sale
1. Subject
These General Terms and Conditions of Sale (GTCS) apply to all services and sales concluded on the www.bewell-society.com website or by telephone, or at events.
The www.bewell-society.com website belongs to:

These General Terms and Conditions apply to the exclusion of all other conditions, in particular those applicable to sales over the internet or by means of other distribution and marketing channels.
Any purchase, order or booking of appointments online or at the event venue implies unreserved acceptance of these GTCS. The customer declares that he/she has read and accepted these terms and conditions before making a purchase. The purchase, validation of the order and booking implies acceptance of the GTCS. The customer must be at least 18 years old and have the legal capacity or parental authorisation to place an order on the www.bewell-society.com website.
2. Services & Products
The customer acknowledges having been informed of the following information prior to any transaction. Be Well Society offers hospitality and wellness strategy consulting services, holistic care services (naturopathy, nutrition and micronutrition, massages and sound baths using Tibetan and crystal bowls), and the sale of publications, online training courses and wellness products.
Consultancy and treatment services are provided in accordance with the customer's specific needs, as defined in advance in a quote or mission proposal.
Products are valid as long as they are online and are offered while stocks last.
3. Quotation & Order
A personalised quotation will be issued for each service requested. The order will be considered firm and definitive once the quotation has been accepted by the customer, evidenced by a handwritten or electronic signature and the payment of a deposit (where applicable). Any quotation not accepted within one month may be revised.
You can place an order for a service or product via the www.bewell-society.com website. Contractual information is presented in French and will be confirmed at the latest when your order is validated. If you do not receive confirmation emails, please check your spam folder.
Be Well Society reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem, or in the event of any difficulty concerning the order received.
The data recorded by the www.bewell-society.com website when orders are validated constitutes proof of all transactions between the www.bewell-society.com website and its customers. The data recorded by the payment system constitutes proof of the financial transactions.
4. Prices & Payment
The prices of the services and products listed on the www.bewell-society.com website are quoted in euros, exclusive of tax (VAT not applicable, article 293B of the General Tax Code), and exclusive of processing and delivery charges.
Be Well Society reserves the right to change prices at any time and without notice. However, it undertakes to invoice the services and products at the rates in force at the time the order is validated and subject to availability.
Payment for services is made as follows:

A deposit of 30% when the order is placed (if applicable)

The balance on completion of the service.
Payments must be made by bank transfer. In the event of late payment, late payment penalties will be payable without the need for a reminder, calculated on the basis of 3 times the legal interest rate, to which will be added a fixed indemnity for collection costs of €40.
Payment for products on the www.bewell-society.com website is due immediately upon ordering by credit card. Payment is secured via PayPal and Stripe. Be Well Society undertakes to store bank details only for the time required for the transaction. You can also pay for your order by bank transfer. In this case, please contact Be Well Society at contact@bewell-society.com. Orders will only be processed once payment has been received. From the date of receipt of payment, Be Well Society undertakes to process the order within 48 hours.
If you order products from a country other than mainland France, you are the importer of the product(s) concerned. Customs duties, or other local taxes, or import duties, or state taxes, may be payable. These rights and sums are not the responsibility of Be Well Society. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to check these aspects with your local authorities. All orders, whatever their origin, are payable in euros (€).
As soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you. Be Well Society is in no way responsible for any damage to or theft of the goods once the parcel or letter has been deposited at the post office.
The services and products remain the property of Be Well Society until full payment has been received. The purchase of services and products in no way transfers the copyright of the creation to the buyer. All creations presented on this site are the exclusive property of Be Well Society. For more information on intellectual property, please read the section on ‘Intellectual property’.
5. Right of withdrawal
In accordance with the provisions of article L.121-21 of the French Consumer Code, you have ‘a period of 14 clear days to exercise your right of withdrawal without having to justify your reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods’. The withdrawal period runs from the time the order is paid for online.
Returns must be in their original condition and complete (packaging, accessories, booklet, etc.). In this case, you are liable. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. You are responsible for the cost of returning the goods, unless otherwise indicated by email.
If you exercise your right of withdrawal, Be Well Society will reimburse the sums paid within 14 days from the date of receipt of your order, in its original condition, and by the same means of payment used for the order.
In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal may not be exercised for:

Contracts for the provision of services that have been fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement by the consumer and express renunciation of his right of withdrawal. Thus, if the service is provided within 14 days of payment, you expressly waive your right of withdrawal.

The delivery of goods made to the consumer's specifications or clearly personalised.

The delivery of digital content (not supplied on a tangible medium) where performance has begun after the consumer has given their express prior consent and expressly waived their right of withdrawal.
6. Delivery
Products are delivered to the delivery address indicated during the order process, within the time indicated on the order confirmation page. In the event of a delay in shipment, an email will be sent to you to inform you of any consequences for the delivery time indicated.
Be Well Society cannot be held responsible for delays in delivery due to the Post Office or due to the buyer's inability to receive or collect the parcel.
7. Postponement, Modification or Cancellation of an Appointment
An appointment may be changed or cancelled at no extra cost by notifying Be Well Society as soon as possible by email at contact@bewell-society.com. However, if the customer cancels less than 48 hours in advance (or fails to show up for the appointment), the session is due and no refund will be possible. In the event of modification or cancellation by Be Well Society, the customer has the option of rescheduling the appointment to a later date or receiving a full refund.
8. Responsibility
The treatments and well-being advice offered by Alexandra Rabeil of Be Well Society are not intended to replace medical advice or treatment. They have no medical purpose. Customers are advised to consult their doctor before making an appointment. The sole aim of these services is the customer's well-being and, in this sense, they are a complementary approach.
We would also like to remind you that food supplements and essential oils contain powerful active substances and can be dangerous if used incorrectly and without precaution. The term ‘natural’ is not synonymous with harmless. Each person will react differently. The effectiveness and results of applying the advice or treatment given cannot, therefore, be guaranteed.
Be Well Society's liability is limited to the amount of the services invoiced. It may not be held liable for indirect damage, loss of turnover or any other loss suffered by the customer.
With regard to the use of the www.bewell-society.com website, customers are invited to visit the Privacy Policy page to find out about the rules, particularly those relating to the protection of privacy.
9. Intellectual Property
All elements of the www.bewell-society.com website are and remain the exclusive intellectual property of Be Well Society. No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual, video, or audio.
You may place a link to www.bewell-society.com on your website, blog or social network and may also quote passages from the www.bewell-society.com website in accordance with article L.122-4 of the French Intellectual Property Code, subject to the following condition (article L.122-5 paragraph 3): The source must be mentioned with a link to the www.bewell-society.com website.
10. Protection of Personal Data
Be Well Society reserves the right to collect nominative information and personal data concerning the customer. This information is necessary to manage the order and to improve the services and information sent to the customer. It may also be transmitted to companies that contribute to this relationship, such as those responsible for carrying out services and orders for their management, execution, processing and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of 6 January 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website. To exercise these rights, please contact Be Well Society at contact@bewell-society.com, stating the subject of your request.
11. Jurisdiction & Applicable Law
These GTCS are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before initiating any legal proceedings. In the absence of an amicable agreement, the competent courts will be those of Paris (75, France).
